A Phase I ESA is written by the Environmental Professional, and the one thing you must never do is make their call for them. The move is a red-team audit: read the report as the adversary would for the buyer or lender, and pull every Recognized Environmental Condition (REC), Historical REC (HREC), Controlled REC (CREC), data gap, and de minimis condition it names. Quoting the report's own language and section reference. The hard rule is the whole lesson: never conclude the site is 'clean,' never recommend 'no further action,' never downgrade a REC. Those are the Environmental Professional's determinations, and Phase II sampling is the escalation. Surface the data gaps instead of smoothing them. The record that wasn't available is exactly where the liability hides. The adversary's real edge is distrust of the report's own comfort language: wherever it downgrades a finding or calls a gap immaterial, you quote that reassurance and make it prove itself, rather than exhaustively cataloging and accepting what the report already concluded.
